Jürgen Tschernutter (#49) of EHC Alge Elastic Lustenau, time approximately 38:21, made contact with an opponent deemed as a Check to the Head or Neck, IIHF Rule 124. The video evidence was sent to the AHL Player Safety Committee (PSC), which determined the incident to be worthy of supplementary discipline - Category 2 – 'Reckless’ – insufficient attention or thought to avoid harm or error. Liable to happen as a consequence of, by intending to affect an opponent through a reactionary or accidental motion or the incident is deemed careless causing negligence.

According to the Arbitrator and having considered the video evidence and ruling of the AHL PSC, player Jürgen Tschernutter (#49) of EHC Alge Elastic Lustenau, will receive supplementary discipline under rule 124 – Checking to the Head or Neck.

On December 26th, in Lustenau a body check occurred that is deemed a check to the head. With a quick transition play occurring in the neutral zone, moving towards Lustenau' defensive zone, Jürgen Tschernutter (#49) of Lustenau stepped up at the blue line to make a body check. The body check made contact directly to the head of the opposing player. As the video shows, the opposing player never did have possession or control of the puck, so he is not eligible to be checked.

The opposing player did look down momentarily to look for the puck, but considered normal, which eliminates the opposing player as part of the circumstance. In an effort by the opposing player too play the puck, and at the same time, Jürgen Tschernutter made the body check, which was unsuspecting to the opposing player. The reason for supplementary disicipline is due to the force of the check, with no regard for the puck. The right shoulder of Jürgen Tschernutter elevated slightly up, making direct contact to the opposing players head. It is a check made in an effort more to eliminate the puck carrier from the game, than the puck from the puck carrier. The opposing player did sustain an apparent injury.

Effective immediately, Jürgen Tschernutter (#49) suspended for 3 games.
