Timo Pallierer (#60) of Vienna Capitals Silver, time 33:53, made contact with an opponent deemed as Illegal Check to the Head or Neck, IIHF Rule 48. Based on the video evidence, it is determined the incident to be worthy of supplementary discipline - Category 1– ‘Careless’ – insufficient attention or thought to avoid harm or error. Liable to happen as a consequence of, by intending to affect an opponent through a reactionary or accidental motion or the incident is deemed careless causing negligence.

According to the Arbitrator and having considered the video evidence and ruling of the AHL PSC, player Timo Pallierer (#60) of Vienna Capitals Silver will receive supplementary discipline under rule 42 – Charging.

On Saturday night, February 5th, in Zell am See an incident occurred, deemed as charging. Vienna Capitals D'Man, #60, Timo Pallierer was assessed a 2+2 penalty for a CTH on EKZ forward, #23, Christian Jennes. As the video shows, in the 2nd period, the puck is traveling around the boards, after a shot attempt from a Vienna D/Man, creating a race for the puck, with Jennes winning the race to the puck and having only the ability to chip the puck, before being checked. Simultaneously, Pallierer drops down from the point, creating speed and no regard for the puck, making a check with excessive momentum and a considerable distance, finishing the check violently and with over warranted force, making at minimum, a form of head contact.

The AHL PSC has deemed the check as warranting supplementary discipline under charging.

It is important to note, the relevant portion of the 'charging' definition. IIHF Rule 42 - "Charging shall mean the actions of a Player who either jumps to check an opponent, builds up speed by taking multiple strides immediately prior to making contact and / or travels an excessive distance with the sole purpose of delivering such a hit and / or violently checks an opponent in any manner."

Pallierer does not attempt to make a play on the puck with his stick. Instead, he takes 1 hand off, turns his shoulder and loads up for contact. Pallierer intention on this play is to deliver a hard and violent check to the opponent with the outcome being a high, predatory type check. Although it appears Jennes did not sustain an apparent injury, the potential of a serious injury on this type of check is very high.
